Judicial Framework And Independence: 

In October, the UN Human Rights Committee ruled that Uzbekistan is obligated to investigate the claims of exiled activist Mutabar Tadjibayeva, who says authorities in Uzbekistan arrested and tortured her repeatedly from 2002 to 2009, violating the International Covenant on Civil and Political Rights, which Uzbekistan acceded to in 1995.[51] In their decision, the UN committee wrote that, “instead of providing detailed information and explanations to the Committee in refutation, the State party [Uzbekistan] accused the author [Tadjibayeva] of having presented ‘invented and biased’ allegations.” Uzbekistan state officials have shown no intention of following through with the UN’s request for an investigation of Tadjibayeva’s injuries, which include forced sterilization, wounds and trauma from torture and gang rape, and memory loss.

In February 2015, the banned opposition group Birdamlik and human rights defender Mutabar Tadjibayeva protested against the unconstitutional presidential elections of March 29, 2015, by staging their own virtual alternative election. The organizers launched a virtual election committee’s website at Saylov2015.org, where people could cast a vote for eleven presidential candidates (excluding President Karimov).

UN urges Uzbekistan to investigate torture and ill-treatment of human rights defender forcibly sterilised in detention

One of the main UN bodies that monitor States’ compliance with their human rights obligations has found the Uzbek Government responsible for the torture and ill-treatment of Mutabar Tadjibayeva, a well-known human rights defender.

Ms Tadjibayeva was incarcerated for her human rights activities in 2005-2008 and has been living in exile in Paris since 2009.

In a landmark case, the UN Human Rights Committee (UNHRC) has ruled in favour of human rights defender Ms Mutabar Tadjibayeva, who was arrested, tortured, raped and forcedly sterilised by Uzbek authorities.

On 6 October 2015, the Committee – after determining that there was detailed evidence of the abuses she suffered – ruled that Uzbekistan is obligated to conduct an impartial investigation, to begin criminal proceedings against those responsible for the violations, and to offer compensation to Tabjibayeva.

The UN Human Rights Committee this week decided in favor of Mutabar Tadjibayeva, who says authorities in Uzbekistan arrested and tortured her repeatedly from 2002 to 2009, violating the International Covenant on Civil and Political Rights. Uzbekistan acceded to the treaty in 1995.

Mutabar Tadjibayeva is remarkable, even among human rights defenders.

Her story is well-known in human rights circles: arrested, detained and tortured in Uzbekistan’s prisons, she was released on medical grounds and allowed to leave the country in 2008. معتبر تاجی بائِوا، رییس سازمان کلوب قلب های آتشین، می گوید: «اگر بگویند یک روز از زندگی ات باقی است، آن را برای مبارزه در راه حقوق بشر خواهم گذراند.» روزنامه نگار و فعال 52 ساله ازبک در سال 2009 به عنوان پناهنده سیاسی وارد فرانسه شد. او دیگر در کشور زادگاهش، که ربع قرن زیر حاکمیت دیکتاتور اسلام کریم اف بوده، پذیرفته نیست. معتبر در ازبکستان در باره قاچاق مواد مخدر، فساد و نقض حقوق بشر تحقیق می کرد. او در نبردی با هزینه بالا تهدید، زندان، شکنجه و تجاوز را از سر گذرانده است.

Le dixième anniversaire du massacre d’Andijan sera commémoré le 13 mai. A cette occasion, la FIDH, Reporters sans Frontières (RSF), l’ACAT (Action des Chrétiens pour l’abolition de la torture) et le «Club des Cœurs Ardents» (Fiery Hearts Club) appellent la communauté internationale à ne pas oublier l’un des massacres de civils les plus sanglants d’Asie centrale.
