The Prosecutor General of Kazakhstan made a decision to extradite Uzbek asylum seeker Khairullo Tursunov back to Uzbekistan.

Asylum seeker Khairullo Tursunov, who has been held for seven months in pre-trial detention center of Aktobe city, is already informed about the decision of Attorney General.

“Jarayon” found out that the Uzbek side is accusing Khairullo Tursunov in cooperating with 29 Uzbek refugees, who were extradited from Kazakhstan one year ago. The indictment document states that Tursunov was in cahoots with them to overthrow the constitutional regime of Uzbekistan.

The document, sent by the Uzbek side, says that Khairullo Tursunov is accused of being a member of banned organizations “Islamic Movement of Uzbekistan” and “Islamic Jihad Movement of Turkestan”.

However, Tursunov denies all of these allegations. He has a month to appeal against the decision of the Prosecutor General.

Uzbek asylum seeker’s lawyer Kenes Zhusupov said he filed a complaint to the court of Aktobe.

“In the statement we wrote that all these allegations are defamatory, and that Tursunov is not guilty. We asked the court to release him from custody,”- said the lawyer in a phone conversation with a reporter of “Jarayon”.

According Zhusupov, if the city court fails to satisfy the appeal, they have a right to apply to the regional court.

“If the regional court rules against us, Tursunov can be extradited to Uzbekistan,” – said the lawyer Kenes Zhusupov.

We recently reported that the security forces of Uzbekistan accused 37-year-old Khairullo Tursunov, native of Kashkadarya region, in charges of terrorism.

Department of the Committee on Migration of Almaty city and the UN High Commissioner for Refugees (UNHCR) in Almaty refused Tursunov and his family refugee status in Kazakhstan.

In 2011, Kazakhstan extradited 29 refugees to Uzbekistan. After extradition, on June 20, 2012, the UN Committee against Torture made a statement that Kazakhstan, extraditing 29 Uzbek refugees to Uzbekistan, had violated its international obligations in the field of human rights, to be precise, two articles of the International Convention against Torture.

Torture is used systematically in Uzbekistan. Therefore, according to international human rights organizations, extradition of people to this country is prohibited.

The UN Committee against Torture demanded that Kazakh authorities provide appropriate protection to extradited 29 Uzbek refugees, including their return to Kazakhstan, and pay them compensation.

So far the Kazakh authorities have not reacted to the decision of the UN Committee against Torture.

Observers note that extradition Khairullo Tursunov to Uzbekistan is impossible, since it is contrary to the international obligations of Kazakhstan.
